Formula 1 User Generated Content Terms and Conditions
 

1. By submitting content (the “Content”), which may include, without limitation, audio-visual content, still images, audio, text and graphics, to Formula One Digital Media Limited (“F1”) you agree to the terms and conditions set out below.

 

2. By submitting Content you understand and agree that F1 nor any Licensed Party has any obligation to use the Content in any way and to the extent that F1 or any Licensed Party uses the Content it shall be under no obligation to continue using it.

 

3. When you submit Content to F1, you grant F1, its affiliates and F1’s and/or its affiliates authorised third parties (the “Licensed Parties”) a non-exclusive, irrevocable, perpetual, transferrable, worldwide, sublicensable, royalty-free right to reproduce, broadcast, publish, transmit, perform, display, edit, create derivative works from, translate, adapt, modify, distribute, exhibit, disseminate and otherwise exploit such Content for any purpose whatsoever, including, without limitation, on Formula 1 social media channels, the Formula 1 website, as part of the coverage of any and all Formula 1 events and related edits.

 

4. You consent to the Licensed Parties using your name, username, social handle, image, likeness, voice and any other identifying information in connection with any use of the Content as set out in these terms and conditions.

 

5. You represent and warrant to us that:

 

1. 1. you are at least 18 years of age;

 

1. 2. the Content is your own original work and you own all rights in and to the Content;

 

1. 3. you have the permission of anyone who is identifiable in the Content (or the parent/guardian of anyone who is identifiable but is under the age of 18) for the Licensed Parties to use the Content as set out in these terms and conditions;

 

1. 4. use of the Content as set out in these terms and conditions will not violate the rights, including intellectual property rights, of any third party or any law, rule or regulation;

 

1. 5. the Content does not contain any advertising or other commercial content; and

 

1. 6. the Content is not libellous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, or offensive or otherwise unlawful or prejudicial of any person or group.

 

6. By submitting Content you irrevocably waive any “moral rights” or other rights with respect to attribution of authorship of the Content and the Licensed Parties shall not be required to reference the author or creator of the Content in their use of the Content.

 

7. You hereby agree to indemnify and hold the Licensed Parties harmless from and against any and all third-party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of these terms and conditions.

 

8. By submitting Content you are consenting to the Licensed Parties’ collection of any personal information you provide for the Licensed Parties’ use in connection with the use of the Content as set out in these terms and conditions. F1 shall use and take care of any personal information you supply in submitting Content as described in its privacy policy.

 

9. If any part of these terms and conditions becomes invalid, illegal or unenforceable in any respect under any law or for any other reason whatsoever, the validity, legality and enforceability of the remaining provisions shall not be affected.

 

10. These terms and conditions will be governed by English law and you submit to the exclusive jurisdiction of the English courts. However, you may have statutory or legal rights in the territory where you live which may apply.
